I-485 need to file when your PD need to be current.
Indian Bro/sister need to wait 10 years to file I-485.
So you can file I-485 in 2020 AD.

Currently I am in US in H1B and my I-94 is expires in Sept 30 2010 and there is an extension filed for my H1.
In the mean time I want to file I-130 and I-485 based on my brothers citizenship.
Whether the status will change before sept 30 2010? Also if I leave US whether the application will be still valid and how much time it takes to get an approval for both?

While setting up an appointment through VFS for H1B stamping in Mumbai, I am asked the following question:
Are you applying for the same class of visa which is currently valid or has expired within the past 12 months?
Should I answer Yes or No? I guess the answer is Yes since I have a valid I797 H1 approval. But, I need expert opinions from you guys as well. Here is some background:
I have H1 visa stamp through my old employer "O" (with an expiry of March 2006). I changed employer "X" in Nov 2003. My H1B has also been renewed in Nov 2006 (with "X"). i.e. I have had two valid I797 H1 approval notice with "X" since Nov 2003 - one for change of employment through my current employer from Nov 2003 to Nov 2006 and then a renewal from Nov 2006 to Nov 2009 (this is currently valid). I have not been to India since July 2003.
Please advise what the answer to the questions above. Also, is this visa stamping considered a renewal since my old visa stamp is through my old employer?

I was going through the processing times bulletin which they normally release around 15th of every month and noticed that though date at top says (Posted: September 28, 2008 ) but before the list starts they have written
.................Service Center Processing Dates for Nebraska Service Center as of: July 31, 2008.
Now what is that, have they lost track of dates being considered as of today.............. I can understanb things might standstill for I-485 (dues of non availability of visa numbers), but what about I-140, for last few months it does not jumpout of that March shell.
Also what do they mean by as of July 31, 2008, can we not know someohow as of October 8th or September 28th, what cases are they considering .

You maintain H-1B status as long as there is a relationship between u and ur company. This is usually showed by paystubs. If you do not, you can apply for H-1B transfer, but then the extension of stay will most likely not be granted, as the USCIS needs to see your paystubs. I would speak to an attorney about this.

Could you please let me know if I can buy the health insurance only for her? Is there some law which states H1B visa holder also needs to buy the health insurance along with the spouse?

Due to Iceland's volcanic ash my MIL trip has to be postponed. She was on visitor visa. We filed an extension with USCIS and paid $300. She left US as soon as flights started to resume.
USCIS approved her extension 30 days after she left US.
a) Can we seek a refund because this extension has to be filled due to reasons beyond our control
b) In the future how to seek a fee waiver (any tips or advice please).
c) Can we seek fee waiver when we e-file a petition.

I am in a very bad condition n would appreciate anyone who can advice me on same. I had been out of status for about 1 yr n 2 months following my denial of I 140 n expiration of H1b, n currently residing in US. Now i have a new approval for H1b from USCIS, a month back. I was instructed by my employer to go back to my native country n get approval from from the consulate n re enter US. My lawyer instructed that i will be barred at the consulate or at the airport due to the history of over stay in US upon re-entering . Is there any one who have heard experinces of this kind ever? plz share your knowledge... thanks

I am currently in the U.S on H1b for the past 4 years. My H1b is for a computer programmer. I work my day job in that capacity. My Labor certification in under process. I have also been auditioning as an actor for Commercials and Industrial Films. It looks like I may be cast in an industrial film. My question is : If I accept the part, will this violate the terms of my H1-b ? Also, if I am approved for an EAD down the road, can I use the EAD to do acting work on the side ? Here is my situation and looking for any previous experience and suggestion from experts.
I have my EAD valid for 2 years PD 05 EB2. I got a job from another company but vendor says I need to be in his payroll. Job wise everything is good. I want to join him on EAD.
Here are my concerns
1. Should file for AC21 or just keep quite till CIS sends a letter ?
2. If I ensure my new job and old job responsibilities are same, am I safe ?
Do you see any problems or advise me for anything.

You can go and get it stamped in Canada. I went to Ottawa on Jan 25th and got it stamped same boat as you.

Mail it in, if it's rejected you do not lose anything. According to the law (8 USC 1255) the USCIS should accept it.

Hello,
Can someone give me a brief idea as to how long it takes for the USCIS to respond to an MTR? I think I read somewhere that they respond within 60 days. Is that accurate? My MTR was filed 2 months back & I have not yet heard back from the USCIS. It was filed at TSC.
