    I am on L1B visa from Apr 2008. I have my PERM and I140 approved.
    I got a email from my attorney stating that they want to file my H1B petition this year so that they can keep on renewing my H1b as long as my company wants.

    Suppose they file H1B COS petition then my status will automatically change on Oct 1 2010.

    I am planning a vacation to India in November 2010, what are the options with me when come back to US.

    - Do i have to stamp the H1B visa OR

    - I can still come back on my existing L1B visa ???


    Please suggest

    Folks,
    I have a situation where I need to dump my emp after working for almost 6 years as I am getting new opportunity which requires emp to pay me on 1099(instead of W2). Can it be possible and also can I avoid opening LLC. Also, not sure if in the near future if I get a RFE how that would go with current situation

    Hi,

    Based on what I know, the medical exam has to be less than 1 year old on the date of I-485 application submission. However, I have seen different opinions on this forum. Some state that the exam date cannot be more than 30 days before I-485 submission, because the HIV test and syphyllis test (sorry if not typed correctly) are valid for 30 days only. Could anyone clarify this, please?

    i've been in the US on a f-1 visa since 2006. i am getting my masters at the moment. i am planning on getting married to my girlfriend who is a US citizen. i have been with her for the past 2 years and am dearly in love with her. we plan on getting married and i was wondering if i get married to her, can i apply for a green card right away or do i have to wait for a while before i can apply for a green card. she is also a student getting her bachelors.
    my second question is that if i can apply for a green card then could i take a semester off and return to studying next semester or would that be a problem since i am on an F-1 visa.
    i would appreciate it if i could get an answer soon so that i could take the semester off.

    Please help me decide.

    I have Bsc (3yrs) and MCM(3yrs) (MASTER OF COMPUTER MANAGEMENT) from india .
    Degrees evaluation says "UNITED STATES DEGREE EQUIVALENT BACHELOR OF SCIENCE DEGREE IN COMPUTER SCIENCE"

    6 yrs + experience prior to joining the current recruiter.

    Am I eligible for EB2 category, as my employer says, EB2 be most likely would be rejected/denied and its a big risk

    Let me know your inputs.
