Same thing happen in our case, transfers TSC to local office(FL) for speed processing then after 16 months we got interviews letter from local office to attend the interview.

I've seen people getting the GC Approvals even though their PD is not current. But close to current published dates.
Good Luck to you and Keep your fingers crossed. Technically you are not in, but still you may be in. You never know with USCIS.

My EAD card is probably lost in the mail. Got approved on July 11th and never received so far . My current EAD expires on Augest 9th . I am in the risk of losing the Job. What are my options now .. Please advise ..

The old I-140 is all valid. The only thing that you are taking is the date. When your new I-140 is approved and you interfile with I-485 then you request USCIS to take the new I-140 instead of the old one. Also if your new I-140 has problem at that stage (even after approval, some time it happens), still the old I-140 is valid.

I plan to probably file under the EB2 category soon- I know EB1 and EB2 can be filed separately, however can a EB2 regular and a EB2 with NIW application both be filed separately as well?
Need to know this asap, so would appreciate a reply, Thank You!

I have probably a strange case .In 2007 when all the dates were current my employer filed I-140 & I485 at the same time in EB2 . I have received AP and EAD both according to standard procedure.I have maintained my H1B status. Then after a month or so I have received I-140 rejection due to different job requirement and I am overqualified for the job so my attorney interfiled new I-140 under EB3 without worrying about I 485 thinking since I 140 is denied it should nullify I485 under EB2 . In the mean time USCIS sent me a new I-485 receipt # . I got my I 140 approved in another six months under EB3 and now I have two I 485 receipt numbers as well as two A numbers. Both of the receipts when I checked the status show that it is under initial review. Shall I call USCIS and get rid of the initial I485 which is under EBII . Anyone had this kind of experience??

A federal judge in Phoenix on Wednesday blocked key provisions of Arizona's controversial immigration law from taking effect as scheduled Thursday, granting in part an injunction requested by the Obama administration.
U.S. District Judge Susan Bolton ruled that the injunction would apply to the portion of the state law that requires police to try to determine the immigration status of a person they arrest, stop or detain while enforcing other laws if they reasonably suspect the person is in the United States illegally.
In a lawsuit filed against Arizona, the Obama administration said the law was unconstitutional and warned that the provision would result in racial profiling and harassment of U.S. citizens, legal immigrants and foreign visitors.
Bolton said in her ruling that it was "not in the public interest" for Arizona to enforce a provision that preempts federal enforcement of immigration law.

I am on H1 and my husband on H4.
My 140 is pending.
We recently received EAD for both of us. If my husband applies for SSN but do NOT use EAD or SSN for work . Will he still remain on H4?
I want him to be on h4 status till I get 140 approved.

2) Looks like more applicaiton were filed at NSC than at TSC, Why?
3) Why even then TSC is late in issuing reciept?

My H1B got expired in Sep 2010, ( applied for transfer before expiry), got RFE and finally approval last week, but 797 form has the validity from current date(approved date) instead of requested date in Sep 2010. So now is the period from sep 2010 to 797 approved date is considered as out of status or how it is? I have paystubs during this time and on job all the time. Any implications while going for h1b stamping in India and or at port of entry and in future GC.
Any inputs are apprciated. Thanks!
If I remember correctly, you are allowed to work for 240 days from the receipt date while your case is pending. If the approval does not come within 240 days, you have to stop working and wait for the approval. You are NOT considered out-of-status as long as your petition was filed before the current H1 expired.

In one of the questionnaires, I am asked if my labor / 140 / 485 is pending. I don't know what to answer.

-- if you lie and USCIS finds out then you are in big trouble. Also, existing applications can be looked up at any time (Eg: while adjudicating your 485 they can go over your old L1 application).
Atleast the visa stamping form DS-156 asks if an immigrant visa petition has ever been filed for you, so its not uncommon, dont know about L1.

you should get receipt within a week, so there is not much difference in time.
You can join new co as soon as USCIS recieves your petition, but most people play safe and wait until the receipt notice arrives.
