I am also on the same boat.For me and my wife we only I-765 recipts only and the rest are not there.Checks are also encahsed only for this.I am not sure what is is the logic and which one will follow is it 485 then rest .

My case was approved by BEC on July 18. My attorney says that my 140 has to be filed by July 31 to be eligible to file under July visa bulletin [by 17th August]
Is his interpretation correct?
I can not do concurrent for a few more days, until my family returns from India.
If I go with 140 now, I am afraid the 140 receipt may not arrive in time for me to file for 485.

Hi Buddy,
Put your address in 485 apps. You may at some point want to change the employer under AC21 rule and this will allow you to 'carry' the 485 process with you. Basically you own 485 process whereas it's not the case with labor and I-140.

OPT Can work even for training only right!!!
everify company wthout pay! just incase if we dont get a job, just any employer offer letter is good right!!

I'm talking about post completion OPT - if you have ur EAD card, u can travel with a valid and current employment letter. When it's pre-completion OPT, u r on F1 anyways so u should get stamping...

After many, many years of wait ( to be exact totally 8 ) I was about to pack my belongings and move on with my life but in other place.
For certain reasons, which I will not discuss there I could not return to my home country.
Looking back and analyzing decisions made by the HR and the lawyers that the company hired to handle my case I feel something very uncomfortable. My advice to those who are at the very beginning of the immigration path is "Never under any circumstances trust the immigration lawyer that was hired or recommended by your employer. Remember your employer's interests are exactly opposite to yours."
Anyway yesterday I got that coveted �We sent you an approval notice..." e-mail.
Am I excited? Not very. Certainly I would have been if this happened many years ago.
Another advice that I want to give is do not take this green card business to close to your heart. There are much more important things in this life.

My wife is currently in the US on H4 Status and she is taking classes at a local university on a part time basis.
We are planning to go for our visa revalidation next month.
How should i answer DS 156 Question #33.Do you intend to study in the US? for my wife?
I think i should answer yes since she will continue taking classes after we come back to the US. Will this be an issue since she is on H4?

I think most people think immigrants steal their jobs, but the truth is sometimes we struggle to hire a local person and then a foreigner walks in with the skills we need, but we can't hire him. (this is not to say we have not had good quality local people for the job as well)

I have no US visa stamped in my passport and planning to fly Emirates to India via Dubai. I will use AP for re-entry. Do I need transit visa at Dubai like London and other European Airports? Response from anyone with experience will be appreciated. If already discussed here, guidance to particular forum will help.

I got my EAD renewed recently and by mistake I have interchanged my First Name and Last Name in the application. I received an approved EAD card also with the First Name and Last Name interchanged.
I noticed the problem only when I went to renew my Drivers License.
My questions are
1) What is the process to get the names rectified on an approved EAD
2) If I leave it as it, will it create any issues.

I am in a very bad condition n would appreciate anyone who can advice me on same. I had been out of status for about 1 yr n 2 months following my denial of I 140 n expiration of H1b, n currently residing in US. Now i have a new approval for H1b from USCIS, a month back. I was instructed by my employer to go back to my native country n get approval from from the consulate n re enter US. My lawyer instructed that i will be barred at the consulate or at the airport due to the history of over stay in US upon re-entering . Is there any one who have heard experinces of this kind ever? plz share your knowledge... thanks

Friends,
I have had my GC for about two and a half months now. I am currently checking out SOA consultant positions with a consultancy in Saudi Arabia. I don't know the length of the contracts yet. Can I work out of USA and still apply for Citizenship after the wait of 4 years and 9 months ? Does this require me to stay a certain amount of time in USA for every year ? What are the tax implications ? Would I have to file taxes on the income that I earned out of USA ? Thank you.

Its hard to say what is SAME OR SIMILAR. I am stuck up with the same issue. My GC was filed for the position of Software Engineer and I changed the job with same responsibilities but job title is Project Manager. My attorney is not comfortable with that even though the responsibiities are same in the new job.
Its better not take this AC21 path unless you are 100% sure that your new job is same as the old job.
Experts please advise.

When USCIS ignored AC 21 and denied I-485, did anyone file for Writ of Mandamus?
What are the costs involved?
How much time does it take to get a ruling from the court?
Per Wikipedia "The applicant pleading for the writ of mandamus to be enforced should be able to show that he has a legal right to compel the respondent to do or refrain from doing the specific act. The duty sought to be enforced must have two qualities:[3]It must be a duty of public nature and the duty must be imperative and should not be discretionary."
The last sentence is key. AC21 is the law but USCIS issued multiple 'Memos' clarifying, making rules, giving 'recommendations' etc etc. These memos are not cast in law but sound like "discretionary". It also perhaps depends on the exact reasons for denial. Did the person get an RFE before a denial, the applicant move to same or similar job, was the I140 approved or was it merely 'approvable'. Many moving parts.
