Hi Guys:
I'm in a process of transfering my H1B to a new employer. I've already hired a lawyer and paid him his fee. The lawyer spoke to my employer and everything was going fine. Now, my new employer tells me that his company "froze hiring" untill further notice !?!
I'm wondering
1. Is my employer lying and why?
2. Can I somehow make my employer pay me back the money I already paid to the lawyer?

Hello Folks,
I received a code 2 notice for I765 but i dont have my passport as it was sent to renewal. Eventhough FP Notice says ID card should be one of Alien Card / Drivers license , passport, State issued card my experience earlier says ASC only accepts Passport. Will they accept EAD Card etc as ID ? Any experience different than this ? Please post.
Btw this is my third time i am renewing for EAD.
Please advice.

is it possible and advisable to convert H1 B to H4 and go on searching for job and if find a job then coming back to H1? Are there any risks in this process? if so can some one explain me in detail?
Yes you can switch from H-1b to H4 status. later on when the prospective employer finds a new job for you then that they can file a change of status application from H4 to H-1b under non cap case.

As pappu stated in the first post of the above referenced thread - some of the ongoing efforts include finding how many IV members would get benefit from such a provision and get basic details such as username/Priority Date of impacted members. Future action items might include drafting documents and letters to support this provision. There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.
The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.

In case dependent is in India and priority date is current. Will this impact on getting EAD for dependent and primary applicant.

yes. you cannot file AoS while out of country. you can file for yourself, but will have to file for the dependent/s when they return.

Hi,
I've been in the bay area of California for the past 10 months. I'm a Canadian from Toronto. I've been following this green card mess for the past 10 months and was well aware of it even while I was living back in Canada. I would like to join the Norcal chapter of IV to contribute my thoughts towards resolving this situation.

it states that if you filed after July 30, 2007 then a fee is no longer needed. My I-485 application was filed under the old fee structure. Does it still mean I can file without a fee.

Today, I heard back from a senator and a congressman from New Jersey regarding the webfaxes that I had sent them. Here are a few things that I learnt
The associate in the Senator's office was not aware of this issue and the one in the congressman was only partially aware of it. If this is the situation of the associates who look after immigration with the lawmakers in NJ, where there are thousands of EB-GC aspirants, the situation might much worse in other states.
The associates in the lawmaker's office do take the effort to read through the faxes, thus making it effective to bring our issues to their attention.
Our WebFax application is working fine. Previously I never got replies to my web faxes. What might have helped is the fact that the web fax did have my complete contact information. This makes it more trustworthy in their eyes.
So I request all of you to send out WebFaxes to your lawmakers. It is free for you and takes only a couple of minutes. Once you have sent it, urge your friends also to do the same.
Stand up and be heard.

Here is my situation. My wife is a US citizen and we've been married for 2 year and 3 months, and I have the conditional green card for almost 2 years. I can't say this has been the best time of my life. She has kids of her own, and we ran into so much problem. And we both wish get a divorce. My conditional green card is expiring, and I know a divorce would affect my status. But seems like I can't take this anymore. During this time, I've been with another us citizen. She understand my situation, and has always supported me. I do want to marry her after my divorce. So, I'm seeking for some advice from everybody on what I should do in this situation. Thank you

I am in L2 visa right now and I have an EAD to work. I got a job that I need to start on oct 01.
My spouse status will change from L1 to H1B from oct 01, as his employer filled for H1B.
Our L1 & L2 are valid until Aug 2011.
I don't have H4 yet.
What are the various options available for me to work?
1. Can I use my EAD to work which is valid until aug 2011?
2. Can I apply for H1B for me? If yes when I can start working with my H1B.
3. Is there is any way to maintain my husband L1 status until it's validity(Aug 2011) and then switching to H1B after L1 expires?
