    Lou Dobbs is nothing more than fear-peddler with a TV show to rant a about anything that he does'nt agree with.

    Other TV "news" magazine anchors like Bill O'Rielly, Shaun Hannity or even Micheal Savage (on Radio) have helped to create an atmosphere of hatred even against legal immigrants.

    What a shame...we (legal immigrants) have no friends...:( :confused:

Joining the Congressman will be other Members of Congress and supporting advocacy organizations. Rep Honda will discuss his Reuniting Families Act, to be introduced in Congress this week, and the need to reform America's family-based immigration system to end lengthy separations of loved ones, promote family stability and foster the economic growth that immigrant families have provided throughout our history.

    Provisions related to Employment based Greencards:
    *Recaptures unused family-based and employment-based visas previously allocated by Congress which remain unused.

    * Increases the per country limits of family and employment-based visas from 7% to 10%: Right now, each country only has a 7% share of the total cap of visas that Congress allocates each year. Increasing each country's percentage of visas would eliminate the absurdly long wait times for individuals to immigrant from certain countries like the Philippines, China, and India.

    This bill is similar to S 1085 introduced in the Senate with regard to employment-based visa provsions - basically recapture and increase per country limits from 7 to 10%

    Guys, there is nothing to be excited about for EB folks in this bill.. This appears to help FB folks and in the name of re-union, which is a good thing ofcourse but, for us.. If I read between the lines, I have a bad feeling... Are they trying to re-capture the EB wasted visa numbers along with FB wasted and allocate all those to FB folks? :confused:

    Let the EB folks live this same life?

    Well if it is clearly mentioned in the offer letter that Employer will cover the GC cost, then isnt the employer supposed to pay for it irrespective of when the labor was filed. It was filed in 2006.
    Btw, i am on AOS if that is what was meant from my legal status..

    Like I said before, this is a civil issue and a contract claim. This can be handled by means of a lawsuit as a civil proceeding if you wanted to. The likelihood of you winning the claim is very very slim in court based on my knowlegde. If you want a government agency to help you, that is not going to happen as there is no claim of any violation here.

    If you apply for extnsion, please keep in mind your parents stays in US until you receive their approval extension. If they travel outside the while case pending and if they try to renter before case is approved, they will deny at POE and cancel and 10 Year multiple visa. Be very careful here.

    Hi All:

    Question: I have a I-140 PD Sept 2005 - EB-3, And completed 4.5 years (6year end oin July 2008) on H1. I changed the job in Jan, 2007 and using the approved I-140- 3 year H1 Ext rule, I received my extention for 3 year until 2010. Now my new employer des not want to file for greencard for 1 year. meanwhile if my old employer withdraws my I-140 what would happen in this case, if I start my LC application in jan 2008.

    Thanks again guys.

    Well company A can file my GC but the issue is that the financial books of company A are not clear right now. Hence there are chances I-140 will be refused even if I file on EB1.

    Company B is willing to take me but the issue is how do I join B. The options which I see are that B files my GC under EB2 or EB3 and I continue to work with company A till then. But then in EB2/EB3 the processing will take years till I get my EAD and join company B.

    I got my answer, the very next question talks about I-140 withdrawl and its impact on the AOS application if job changed using portabiliity within 180 days of filing.

    DMT: I couldn't agree more, magazines write differences up or down to make a point - and of course none of us would actually read a magazine where they tested three competing models of DSLR's and the article said "They are all good, just buy any and you'll be happy" - we want them to say that one of them is the best and that the others are ranging from so-so to absolute rubbish [althouhg I probably couldn't tell the difference]. I've had the same discussion on other subjects of magazine articles. Also look at which brand advertizes more and less in a magazine. The journalist working for a magazine MAY not want to upset the biggest advertiser. Further, they need to get "Free test samples". In a motorcycle magazine, one model of Triumph was written down quite badly. Triumph wrote to the publisher and said essentially "If you don't write better about the next bike we lend to you, we will not give you bikes for tests in the future".

    Back to the subject, however: It's important to know what YOU are looking for in a camera. What sort of photos/occasions are you intending to photograph: sports, nature, family & friends, outdoors, indoors, close-up or far away, etc, etc?

    It does not look like your future green card processing will be affected by any way due to your one year absence, but you might wanna clarify with your attorney about the status of your H1 though. You didn't mention anything on this, but I'm guessing you'll be coming back to the same employer in 2010, just check with them if your one year not being in US payroll would result in revocation of your H1B and they have to apply for a fresh one once you come back.

    From the GC front, you don't have anything to worry as far as my knowledge goes.

    I am on H1 for the last 3 years. Got my H1 renewed for 3 years last month. Now i have to go back to India for one year (2009) and come back at 2010. I will not be in a payroll for 2009. When i come back to US at 2010, i am planning to start my Green Card processing. I want to know if my one year stay in India will affect my Green Card processing in any way?

    Hi all ,

    Me and my husband are planning india trip in jun or july this year for 2-3 weeks.We both need to get our visas stamped in New Delhi .
    We are short on time and our native places are far .So to save time and keep the window for passport arrival if approved or any problems ,postal delays..I was thinking to get visa-interview-date the day we land to delhi.
    So here is the probelm,travelling with heavy bags ,international baggage is unsafe and difficult.
    What would be the travel tips ?
    Our plan is-
    1.To stay in some hotel in delhi the day we land( if we reach in evening) and go to stamping next day.
    Where to stay? Should we go to consulate with all international luggageand directly travel for native or keep in hotel room, come back later for it ,is it safr options?

    Traveeling is also difficult

    2.Then for there on ,what transport ,bus,delux bus,train ,or flight to take to chandigarh.
    what ever is easiest for us ?
    For regular bus(i know is pretty fast,5-6 hrs) ,we have to go to ISBT and keep lugaage on top of bus...i dont know about seats...availability .

    For deluxe, never travelled so need tips.
    Or better to take train ,go to railway station.

    I dont know if domestic flgihts allow that much of baggage option, do they allow international luggage ,something like through checkin.

    Please throw in your valuable suggestions to make our trip easy and better usage of time.

    My 2 cents..

    My brother reached Chennai early morning 2 AM and had visa interview at 9 AM. He took the risk and flight arrived on time. This was Mid-Feb 2011.

    I had his visa interview details, so just in case there is flight delay, I was going to inform VFS about travel delay and cancel his appointment. "No show" will get you like 90 days ban.

    I would do the the following - book a hotel room near consulate, leave the bags in hotel, complete the interview, then rent a taxi and to final destination. this option will be convenient compared to bus and train.

    I am confused by why the priority dates for EB2 is worse than EB3. Could someone explain?

    It's because of retrogression. Example....

    Case 1:
    John applied in EB3 in 2002, had his labor/140 cleared.
    John changed companies in 2005, now was eligible for EB2. Used older priority date.
    Now John has 2002 PD in EB2.

    Case 2:
    BEC labors coming through.

    Case 3:
    Non-RIR cases getting approved (note that non-RIR labor takes a long time, ~4-5 yrs)

    Whether to choose EB-2 or EB-3 is hard.

    Fresh blood coming on H1 will typically be EB3. But by the time their visa numbers
    become available, they might move to EB2. Or maybe they won't if EB2 worsens. Right
    now I think it's a fair game between the 2 categories (IMHO).

    If 140 premium starts again, then it might get crazy. Apply for new PERM (choose the least retrogressed category), apply for 140.....all in 5-6 months. Now port your PD from
    whatever earlier 140 you had.

    I don't think there is a rule that once you have a Labor/140 cleared from EB2, you can't
    apply for a fresh labor for EB3 :-)

    As long as your H1-B application is still being processed, you should be IN STATUS.

    For your passport renewal, you can write a cover letter to the Indian Embassy explaining that your visa extension is being processed and provide them a copy of the acknowledgment notice. That should be enough for establishing your legal presence for passport purposes.

    If one is on H1B...applied 485...almost done with 6 years...but got h1b approval for 3 years because of approved I-140...now 485 got denied...should i go back because i completed my six years? or can i stay as long as my H1 is valid (beyond 6 years)?

    I think healthy trade/economic relationship with economic potential powerhouse INDIA is important for the US in the long term. That is why the deal was a done deal long long ago IMHO.

    Can someone please confirm if "Card Production Ordered" email from USCIS mean my 485 is approved and I have gotten GC ?
    Also if May bulletin is Unavailable it still means that GC;s issued if your date is current in April are valid ? My email came yesterday same day as the new May bulletin ?

    May bulletin is effective only in May 09, so you are in good shape.

    I have my labor approved as consultant but the Occ code is 189.167.030 which is Program Manager. I am not sure which one is valid. Also when using AC21 should the new job description match the responsibilities stated for the Job Description or what the employer described as job duties in the application?

    Any thoughts???


    There is a title called consultant. I have labor and I-140 approved on this title.
